01Acceptance of Terms

By accessing this website, requesting a custom list, or purchasing verified data from Emerge Global Solutions ("Emerge"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services or download data files.

02Data License & Permitted Use

Upon full payment for custom lists or database deliveries, Emerge grants you a perpetual, non-exclusive, non-transferable license to use the delivered business contact records for your organization's internal sales, marketing, and business development campaigns.

Restrictions: You agree not to resell, sub-license, publicly publish, or redistribute the raw data files to any third-party data broker without prior written authorization from Emerge Global Solutions.

03Accuracy & Deliverability Guarantee

Emerge guarantees that delivered contact lists have been verified through real-time SMTP handshakes and human QA checks. If any verified list exhibits a hard bounce rate exceeding 2.0% within 30 days of delivery, Emerge will provide replacement records on a 1-for-1 basis upon receipt of standard bounce logs.

04Compliance with Marketing Laws

Customers agree to conduct all outbound marketing campaigns in strict compliance with applicable commercial communication laws, including CAN-SPAM (US), GDPR (EU), CASL (Canada), and Privacy and Electronic Communications Regulations (UK). You must include clear sender identity and functional unsubscribe mechanisms in all outbound communications.

05Limitation of Liability

To the maximum extent permitted by law, Emerge shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of or inability to use our contact intelligence services. Our aggregate liability under any order is limited to the fees paid by customer for that specific delivery.

06Governing Law & Jurisdiction

These Terms and any dispute arising out of or related to our services shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any principles of conflicts of law.
